Overview: Ein Leben ohne Recht scheint in unserer modernen Gesellschaft nicht denkbar. Und wie kam es zur Herausbildung des bürgerlichen Rechts und des modernen Staates?In Karl Marx’ Analyse der bürgerlichen Gesellschaft finden sich Ansätze einer Rechts- und Staatsphilosophie, an die der sowjetische Rechtssoziologe Eugen Paschukanis in den 1920er Jahren anknüpfte. Er zeigte, dass Rechtsverhältnisse unlösbar mit kapitalistischen Tauschbeziehungen verbunden sind: Warenbesitzer treten sich als freie und gleiche Rechtssubjekte gegenüber, denn die "Waren können nicht selbst zu Markte gehen und sich nicht selbst austauschen" (Marx). Für emanzipatorische Bewegungen rund um den Globus ist die Berufung auf das Recht alltägliche Praxis. Dabei gerät oft aus dem Blick, wie das Recht zur Reproduktion von Ausbeutungs- und Herrschaftsverhältnissen beiträgt. Der Band zeigt, dass marxistische Rechtskritik auch im 21. Jahrhundert noch relevant ist.
